Open Tracked provides server-side tag management hosting services on a subscription basis ("Service"). These Terms constitute a legally binding agreement between you and Open Tracked.
We may update these Terms at any time. Changes become effective upon posting. Continued use of the Service constitutes acceptance of updated Terms. We will endeavor to notify you of significant changes by email.

The exact scope of services available under each subscription plan is described on our Pricing page. We reserve the right to modify plan features and pricing, effective from the next billing period.
You must provide accurate information when creating an account and keep it up to date. You are responsible for:
Paid subscriptions are billed on a monthly or annual basis through our payment processor, Paddle. All prices are in USD. By subscribing to a paid plan, you authorize recurring charges to your payment method.
We reserve the right to change pricing with notice. Price changes apply from the next billing cycle.
Each subscription plan includes a monthly request limit per container. If your usage exceeds the plan limit, we may, at our sole discretion: (a) send a warning notification; (b) temporarily restrict the container; or (c) disable the container after a 24-hour grace period.
Free plan accounts are limited to a maximum of three (3) active containers. Containers exceeding this limit may be automatically disabled.
We may disable containers in the following circumstances:

The Service, including its software, design, and content, is owned by Open Tracked and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own legitimate purposes.
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, Open Tracked shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time from your account settings. Upon termination, your data may be retained for up to 30 days before deletion.
These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through applicable legal processes.
If you install the Open Tracked tracking pixel or send us data from your website, you are responsible for: (a) having a lawful basis, and where required the consent, to collect that data from your visitors; (b) publishing the privacy and cookie notices the law requires on your website; and (c) not sending us passwords, payment card numbers, government identification numbers or health information. You must respect visitors' opt-out choices. We process this data on your behalf as described in our Privacy Notice, and you may stop collection at any time by removing the pixel.
